Terms and Conditions

These Terms and Conditions govern access to and use of LingoGap, including free accounts, paid subscriptions, educational content, artificial-intelligence-assisted features and exam-style practice tools.

Please read these Terms carefully before creating an account, purchasing a subscription or using LingoGap.

By creating an account or using LingoGap, you agree to these Terms. When purchasing a paid subscription, you must also accept the applicable contractual terms presented during the checkout process.

1. About LingoGap and the contracting company

LingoGap is an online digital service for learning and practising Danish.

LingoGap is operated and sold under licence by:

References in these Terms to “LingoGap”, “we”, “us” or “our” mean UgleCare ApS when acting as the legal provider, operator and seller of the LingoGap service.

LingoGap may provide:

  • structured Foundation lessons and exercises;
  • grammar, vocabulary, reading, writing, listening, pronunciation and speaking practice;
  • a searchable Danish Word Bank;
  • personal flashcards;
  • spaced-repetition review;
  • saved learning progress;
  • artificial-intelligence-assisted learning tools;
  • writing and speaking correction;
  • Danish-language assistance tools;
  • exam-style reading and writing simulators;
  • automatic and AI-assisted educational assessment;
  • audio functionality; and
  • account and subscription management.

2. Nature of the service

LingoGap combines digital educational content with continuously supplied digital functionality.

The service may include both:

  • pre-produced learning materials, such as lessons, texts, audio and exercises; and
  • interactive digital services, such as saved progress, flashcards, AI processing, subscription management and exam-style assessment.

Most functions require:

  • an internet connection;
  • a supported browser or device; and
  • a signed-in LingoGap account.

3. Educational purpose

LingoGap is intended for personal language learning and educational practice.

LingoGap does not provide:

  • an officially recognised language qualification;
  • an official PD3 examination;
  • an official examination result;
  • guaranteed admission to an educational institution;
  • guaranteed immigration or residence outcomes;
  • guaranteed employment outcomes; or
  • legal, immigration, financial, medical or other regulated professional advice.
  • Users remain responsible for checking current official rules, registration requirements, examination dates and assessment criteria with the relevant authority or examination provider.

4. No official affiliation

LingoGap is an independent learning platform.

References to PD3, Danskuddannelse, Danish language levels or exam-style practice describe the educational context of the material.

Unless expressly stated otherwise, LingoGap is not:

  • operated by a Danish public authority;
  • an official examination provider;
  • authorised to issue official Danish-language certificates;
  • affiliated with an official PD3 examination body; or
  • able to guarantee that its exercises or evaluations match an official examination.

5. Eligibility and age

A person must be at least 18 years old to independently purchase a paid subscription.

A person under 18 may use LingoGap only with the permission and supervision of a parent or legal guardian.

The parent or legal guardian is responsible for:

  • approving the account;
  • approving any payment;
  • supervising use of the service; and
  • ensuring compliance with these Terms.
  • LingoGap is not specifically designed for young children.

6. Account creation

LingoGap may support account creation using:

  • email and password; or
  • a supported third-party authentication method such as Google.
  • Authentication is provided through Firebase Authentication.

Users must provide accurate account information and must not:

  • impersonate another person;
  • use an email account without authorisation;
  • create an account for fraudulent activity;
  • provide deliberately misleading information; or
  • create accounts for unlawful or abusive purposes.
  • A display name may be optional unless required for a specific feature.

7. Account security

Users are responsible for:

  • keeping login credentials secure;
  • protecting access to their email account;
  • not sharing passwords or authentication access;
  • signing out on shared or public devices;
  • keeping recovery information current; and
  • promptly reporting suspected unauthorised access.
  • Passwords are handled through Firebase Authentication and are not intended to be directly accessible to LingoGap.

8. Personal use and account sharing

A LingoGap account is personal to the registered user.

Users must not:

  • share one personal paid account among several unrelated users;
  • sell, rent or transfer an account;
  • disclose login credentials for systematic third-party use;
  • use another person’s account without permission; or
  • use shared accounts to avoid the applicable subscription requirements.
  • Reasonable use of the user’s account on the user’s own supported devices is permitted.

9. Multiple accounts and circumvention

Users must not create or operate multiple accounts to:

  • avoid subscription fees;
  • repeatedly obtain free access;
  • reset or increase AI allowances;
  • obtain additional AI grading allowances;
  • bypass PD3 access restrictions;
  • evade an account restriction;
  • obtain repeated withdrawal or refund benefits;
  • manipulate subscription entitlements; or
  • obtain paid functionality without proper payment.
  • Use of another email address does not automatically make the same individual a new customer for every anti-abuse, payment or refund purpose.
  • Where there is a reasonable indication of misuse, LingoGap may review information already lawfully available through relevant account, subscription, usage and payment records.

10. Free access

LingoGap currently provides a Free access level.

Free access currently includes:

  • the first two Foundation lessons in each Foundation module;
  • a total of ten accessible Foundation lessons under the current five-module structure;
  • all sections and exercises contained within those accessible lessons;
  • access to the Word Bank;
  • personal flashcards;
  • standard and fast flashcard review;
  • spaced-repetition functionality;
  • Danish Assistant tools;
  • Foundation writing and speaking correction within accessible lessons; and
  • a limited monthly allowance for AI-assisted functionality.

Free access does not currently include:

  • the PD3 reading simulator;
  • the PD3 writing simulator;
  • PD3 Writing AI grading; or
  • PD3 Reading Del 1 AI grading.
  • Free functionality may change in the future, provided that users are not retroactively charged for functionality that was clearly presented as free.

11. Starter subscription

Starter currently includes:

  • access to all Foundation lessons;
  • access to all Foundation lesson sections and exercises;
  • the Word Bank;
  • personal flashcards;
  • standard and fast flashcard review;
  • spaced-repetition functionality;
  • Danish Assistant tools;
  • Foundation writing correction;
  • Foundation speaking correction; and
  • a higher monthly AI allowance than Free.

Starter does not currently include:

  • the PD3 reading simulator;
  • the PD3 writing simulator;
  • PD3 Writing AI grading; or
  • PD3 Reading Del 1 AI grading.

12. Basic subscription

Basic currently includes the functionality available through Starter, together with:

  • access to the PD3 reading simulator;
  • access to the PD3 writing simulator;
  • automatic scoring where supported;
  • a monthly allowance for PD3 Writing AI grading;
  • a monthly allowance for PD3 Reading Del 1 AI grading; and
  • a higher general monthly AI allowance than Starter.
  • PD3 grading allowances are separate from general Foundation correction access.

13. Plus subscription

Plus currently includes the functionality available through Basic, together with:

  • a higher general monthly AI allowance; and
  • higher monthly PD3 AI-grading allowances.
  • The exact allowances applicable to Plus are shown on the Pricing page before purchase.

14. Restricted and non-public access levels

LingoGap may maintain non-public access levels for:

  • administration;
  • support;
  • teaching;
  • demonstrations;
  • testing;
  • pilots;
  • internal quality assurance;
  • manual access grants; or
  • separately offered higher-capacity access.
  • A restricted or internal access level is not a publicly purchasable subscription unless LingoGap expressly offers it through an authorised sales process.
  • The existence of a plan or access label in internal software does not create a right for users to purchase or receive it.

15. Public plans and prices

LingoGap currently offers the following public monthly paid subscriptions:

Starter — 49 DKK per month

Basic — 79 DKK per month

Plus — 119 DKK per month

Consumer prices are displayed inclusive of applicable VAT where required and as stated.

The current price, billing interval, included functionality and applicable usage allowances are displayed on the Pricing page before purchase.

The information shown immediately before the user confirms the purchase forms part of the specific subscription offer.

16. Pricing page as the current plan specification

The Pricing page is the primary source for current:

  • public plan availability;
  • plan prices;
  • feature comparisons;
  • general AI allowances;
  • PD3 AI-grading allowances; and
  • other plan-specific usage limits.
  • These Terms define the general contractual framework.

Where a plan feature or allowance may change over time, the version displayed and accepted at the time of purchase applies to that purchase, subject to:

  • later changes validly accepted by the user;
  • lawful service modifications;
  • subscription upgrades selected by the user; and
  • mandatory consumer law.

17. AI usage allowances

AI-assisted functionality is subject to plan-specific usage allowances.

The current general structure is:

  • Free receives the lowest monthly AI allowance;
  • Starter receives a higher allowance than Free;
  • Basic receives a higher allowance than Starter;
  • Plus receives a higher allowance than Basic; and
  • authorised internal or special access may have separate limits.
  • Exact current numerical allowances are displayed on the Pricing page before purchase.

18. Calendar-month reset

Unless expressly stated otherwise, general AI allowances and PD3 AI-grading allowances are measured by UTC calendar month.

They are not currently calculated according to the start and end dates of each user’s Stripe billing period.

This means:

  • allowances normally reset when a new UTC calendar month begins;
  • a subscription may start partway through a calendar month;
  • unused allowance does not automatically carry into the next calendar month; and
  • cancellation does not create a right to convert unused allowance into money or credit.

19. Token accounting

Where the AI provider reports usage information, LingoGap may count both:

  • input or prompt tokens; and
  • output or completion tokens.
  • If provider usage information is unavailable, a request may be recorded without a token amount.
  • A request may still affect other operational counters where applicable.
  • Requests rejected before AI processing because the applicable allowance has already been exhausted do not normally consume AI tokens.
  • If an AI provider reports usage before a later technical failure, the reported usage may be counted.

20. PD3 AI-grading allowances

PD3 AI grading is distinct from ordinary Foundation writing and speaking correction.

Current PD3 AI-grading categories include:

  • PD3 Writing AI grading; and
  • PD3 Reading Del 1 AI grading.
  • Free and Starter do not currently receive PD3 AI-grading allowances.
  • Basic and Plus receive separate monthly allowances for each supported PD3 AI-grading category.
  • The exact numbers are shown on the Pricing page before purchase.
  • Automatic or deterministic scoring that does not use AI may not consume a PD3 AI-grading allowance.

21. Usage safeguards

LingoGap may apply reasonable technical safeguards concerning:

  • request frequency;
  • input size;
  • repeated submissions;
  • automated activity;
  • unusually costly requests;
  • malicious prompts;
  • attempts to circumvent allowances;
  • excessive retry behaviour; or
  • activity that threatens service availability.
  • Safeguards must not be applied in a misleading manner that deprives a paid user of the core access clearly included in the purchased plan.

22. Word Bank

The Word Bank is currently available to signed-in users across Free and paid plans.

It may include:

  • searches for Danish words, phrases and expressions;
  • word details and translations where available;
  • audio or pronunciation functionality;
  • search-result limitations for technical performance; and
  • the ability to save suitable entries as flashcards.
  • A technical limit on the number of results returned in one search is not necessarily a subscription restriction.
  • LingoGap does not currently promise that every possible Danish word or expression will be available or that every entry will be error-free.

23. Flashcards

Flashcard functionality is currently available to signed-in users across Free and paid plans.

Supported functionality may include:

  • manual card creation;
  • cards created from lesson content;
  • cards created from the Word Bank;
  • cards created from selected text;
  • editing and deleting cards;
  • standard review;
  • fast review;
  • spaced-repetition scheduling;
  • review history; and
  • supported audio playback.
  • No public plan-specific card-count or review-count limit currently applies unless one is clearly introduced and disclosed in the future.

24. Foundation lesson access

Free users may access only the Foundation lessons included in Free access.

Starter, Basic and Plus users currently receive access to all Foundation lessons and their included sections and exercises.

Access may be enforced through:

  • account state;
  • subscription information;
  • entitlement logic;
  • application navigation;
  • route checks; and
  • other technical controls.
  • Users must not attempt to circumvent an access restriction merely because a content file, route or technical resource may be discoverable.

25. Additional or experimental learning routes

LingoGap may contain additional, hidden, unlinked, experimental or separately developed learning routes.

The existence of such a route does not automatically mean that it:

  • forms part of a public subscription;
  • is supported for general use;
  • will remain available;
  • is included in marketing claims; or
  • creates a permanent contractual entitlement.
  • Only functionality expressly included in the purchased offer or made generally available as part of the service is guaranteed to the extent required by law.

26. PD3 simulator access

PD3 simulator access currently begins with Basic.

Free and Starter do not currently have:

  • full PD3 simulator access; or
  • a limited PD3 preview entitlement.
  • Basic and Plus currently have access to supported PD3 reading and writing simulator functionality.

Access may include:

  • timed exam-style sections;
  • saved answers;
  • saved attempts;
  • automatic scoring;
  • results;
  • continuation of an unfinished attempt; and
  • AI-assisted grading where included in the user’s allowance.

27. PD3 simulator limitations

The PD3 simulator:

  • is an educational practice tool;
  • is not an official examination;
  • is not operated by an official examination authority;
  • may differ from current official examination formats;
  • may use automatic or AI-assisted assessment;
  • may contain errors;
  • may be updated; and
  • does not guarantee performance in an official exam.
  • Any score, assessment or feedback is an educational estimate.

28. Foundation AI correction

Signed-in users may have access to AI-assisted Foundation correction according to their accessible lessons and available AI allowance.

This may include:

  • writing correction;
  • suggested rewrites;
  • grammar feedback;
  • task-relevance feedback;
  • speaking-transcript correction;
  • vocabulary feedback; and
  • educational explanations.
  • For Free users, Foundation correction is available only in connection with lessons or functionality they can otherwise access.

29. Danish Assistant

Danish Assistant tools are currently available to signed-in users across Free and paid plans.

The tools available may include:

  • writing assistance;
  • speaking assistance;
  • Danish rewriting;
  • conversion of text into Danish;
  • explanations;
  • corrections; and
  • other supported language tools.
  • Free and Starter are not restricted to different Danish Assistant tools merely because they are lower plans. Their practical usage differs primarily through the applicable monthly AI allowance.

30. AI processing

Depending on the requested function, LingoGap may send an external AI provider:

  • written text submitted by the user;
  • a speaking transcript;
  • an exam response;
  • task instructions;
  • lesson context;
  • language preferences; and
  • other information reasonably required to generate the requested response.
  • Users should avoid entering unnecessary sensitive personal information into AI-supported features.

31. AI limitations

AI-generated content may be:

  • incorrect;
  • incomplete;
  • inconsistent;
  • too strict;
  • too lenient;
  • based on a misunderstood response;
  • based on an incorrect transcript;
  • linguistically unnatural; or
  • unsuitable for an official purpose.

LingoGap does not guarantee that:

  • every error will be detected;
  • every correction will be accurate;
  • repeated submissions will receive identical results;
  • an AI score will match a human examiner;
  • an AI service will always be available;
  • AI feedback will remain unchanged over time; or
  • use of AI will produce a particular learning or examination result.
  • AI feedback is educational guidance, not an official decision.

32. Speaking recognition and transcripts

Speaking functionality may rely on browser-based or third-party speech-recognition technology.

Speech recognition may incorrectly transcribe:

  • pronunciation;
  • accents;
  • names;
  • numbers;
  • pauses;
  • background speech; or
  • unclear audio.
  • Where AI processing receives a transcript rather than the original recording, the resulting feedback is based on that transcript.
  • An inaccurate transcript may therefore affect the feedback.

33. Payments processed by Stripe

UgleCare ApS is the legal seller of paid LingoGap subscriptions.

Paid subscriptions are purchased through hosted Stripe Checkout, and Stripe processes payment-card and billing information.

LingoGap may provide Stripe with information required to create and manage the subscription, including:

  • the user’s account identifier;
  • account email;
  • selected plan;
  • Stripe customer identifier;
  • Stripe subscription identifier; and
  • relevant subscription metadata.
  • Full payment-card details are entered through Stripe’s hosted payment interface and are not intended to pass through or be stored on LingoGap’s own application servers.
  • Stripe’s own terms and privacy information may also apply to Stripe’s processing.

34. Formation of a paid subscription

A paid subscription contract is concluded between the user and UgleCare ApS, operating under the service and trading name LingoGap.

A paid subscription is formed when:

  • 1. the user selects a paid plan;
  • 2. the price and recurring nature of the subscription are displayed;
  • 3. the user completes the Stripe Checkout process;
  • 4. Stripe accepts and confirms the subscription; and
  • 5. the subscription is associated with the relevant LingoGap account.
  • A short technical delay may occur while Stripe confirmation is synchronised with LingoGap.

If payment is completed but paid access is not activated within a reasonable time, the user should contact:

support@lingogap.dk

35. Immediate commencement of the service

Paid access normally begins shortly after successful payment and subscription confirmation.

During Checkout, the user may be required to expressly request that LingoGap begin providing the service before the end of the statutory withdrawal period.

The consequences of requesting immediate performance are described in the Withdrawal, Cancellation and Refund Policy.

36. Automatic monthly renewal

Paid subscriptions renew automatically each month until cancelled.

By purchasing a subscription, the user authorises Stripe to charge the applicable recurring subscription price using the selected payment method.

Before purchase, LingoGap must clearly present:

  • the plan;
  • the price;
  • the billing interval;
  • the recurring nature of the payment;
  • applicable VAT information;
  • the main included functionality; and
  • relevant cancellation information.
  • The user must cancel before the applicable future renewal if the user does not wish to continue.

37. Failed payments

If payment fails, Stripe may:

  • retry the payment;
  • request updated payment information;
  • mark the subscription as incomplete, past due or unpaid; or
  • cancel or end the subscription.
  • LingoGap may temporarily preserve paid access while Stripe is processing a recoverable billing issue.

Paid access may end or return to Free access when:

  • the paid period expires;
  • payment remains unresolved;
  • the subscription is cancelled or deleted;
  • Stripe no longer reports an eligible subscription status; or
  • another valid billing condition ends the entitlement.

38. Upgrades

Eligible users may upgrade through Stripe Customer Portal or another Stripe-hosted subscription-management process.

Before confirmation, Stripe may display:

  • the new plan;
  • the effective date;
  • an immediate charge;
  • a credit;
  • a proration; or
  • another price adjustment.
  • The financial calculation shown by Stripe before confirmation applies to the selected upgrade.
  • LingoGap does not independently promise a particular proration formula beyond the calculation displayed and applied through Stripe.
  • An upgrade may take effect immediately after successful Stripe confirmation and entitlement synchronisation.

39. Downgrades

LingoGap does not currently offer an immediate downgrade during an active paid subscription period.

A user wishing to move to a lower plan must generally:

  • 1. cancel the current subscription or allow it to end;
  • 2. retain the current paid plan until the end of the paid period; and
  • 3. select an available lower plan after the existing subscription has ended.
  • A lower plan may therefore be displayed as available only after the current subscription ends.

40. Subscription cancellation

Users may cancel future automatic renewal electronically through Stripe Customer Portal.

The portal may also allow users to:

  • update payment information;
  • view invoices;
  • review billing information; and
  • manage the subscription.

An ordinary cancellation:

  • stops future automatic renewal;
  • normally takes effect at the end of the current paid period;
  • normally allows paid access to continue until that period ends;
  • does not delete the account;
  • does not delete learning data; and
  • does not automatically create a refund.
  • Signing out, deleting a home-screen shortcut, clearing browser data or stopping use does not cancel the Stripe subscription.

41. Alternative cancellation assistance

If Stripe Customer Portal is unavailable or the user cannot complete cancellation electronically, the user may send a clear cancellation request to:

support@lingogap.dk

LingoGap will assess the cancellation using the time at which a sufficiently clear request was received.

LingoGap may request information reasonably necessary to identify the account and subscription.

42. Right of withdrawal

A consumer who enters into the subscription online generally has a statutory 14-day right of withdrawal.

The applicable withdrawal period generally begins when the subscription contract is concluded.

To exercise the right, the consumer must send a clear statement before the deadline to:

support@lingogap.dk

If the consumer expressly requested immediate commencement of the service, LingoGap may, where permitted by applicable law, retain or charge a proportionate amount for the service supplied before the withdrawal notice was received.

LingoGap does not provide a separate unconditional 14-day money-back guarantee.

Detailed rules are provided in the Withdrawal, Cancellation and Refund Policy.

43. Refunds

Cancellation does not automatically create a refund.

Refund requests are reviewed separately.

A refund, price reduction or other remedy may be required or considered in circumstances including:

  • a valid statutory withdrawal;
  • a duplicate payment;
  • an incorrect charge;
  • a payment after a completed cancellation;
  • an unauthorised transaction;
  • failure to activate paid access;
  • serious and unresolved non-conformity;
  • a prolonged material technical failure attributable to LingoGap; or
  • another situation in which mandatory law requires a remedy.

A renewal is not normally refundable merely because the user:

  • forgot to cancel;
  • did not use the service;
  • used it less than expected;
  • changed their mind after renewal; or
  • no longer needs the subscription.
  • Mandatory consumer rights remain unaffected.

44. Separate subscription actions

The following are separate actions:

  • exercising the statutory right of withdrawal;
  • cancelling future automatic renewal;
  • refunding a payment;
  • immediately ending paid access;
  • changing a plan; and
  • deleting an account and personal data.
  • Users must not assume that completing one of these actions automatically completes the others unless LingoGap expressly confirms it.

45. User submissions

User submissions may include:

  • written answers;
  • speaking transcripts;
  • exam responses;
  • AI prompts;
  • saved vocabulary;
  • flashcards;
  • profile information;
  • preferences; and
  • support communications.
  • Users retain the rights they hold in their original content.

Users grant LingoGap a limited, non-exclusive licence to receive, store, reproduce, process, transmit, analyse and display submitted content only as reasonably necessary to:

  • provide the requested functionality;
  • save progress;
  • create flashcards;
  • generate feedback;
  • administer the account;
  • apply usage limits;
  • maintain security;
  • investigate technical problems;
  • comply with law; and
  • protect legal rights.
  • This licence does not transfer ownership of the user’s original content to LingoGap.

46. Rules for submitted content

Users must not submit:

  • content they have no right to use;
  • another person’s confidential information without permission;
  • unnecessary sensitive personal information;
  • malicious code;
  • unlawful threats or harassment;
  • infringing material;
  • content intended to attack or manipulate the service;
  • child sexual abuse material; or
  • other content prohibited by law.

47. LingoGap intellectual property

The intellectual property used in or made available through LingoGap is owned by the relevant rights holders and is made available by UgleCare ApS under applicable ownership, licence or service arrangements.

All applicable rights are retained in:

  • lessons;
  • exercises;
  • reading texts;
  • grammar explanations;
  • educational structures;
  • audio;
  • graphics;
  • software;
  • databases;
  • interface design;
  • Word Bank organisation;
  • simulator structures;
  • AI evaluation systems;
  • branding;
  • logos; and
  • other platform materials.
  • Nothing in these Terms transfers ownership of LingoGap, its original content or its intellectual property to UgleCare ApS, a user or any other party except where expressly agreed in a separate written agreement.
  • A subscription grants the user a personal, limited, non-exclusive, non-transferable and revocable right to use LingoGap for individual educational purposes.
  • It does not transfer ownership of LingoGap content.

48. Permitted use

Users may:

  • access content included in their plan;
  • complete exercises;
  • use the Word Bank;
  • create personal flashcards;
  • use feedback for personal study;
  • retain reasonable personal notes; and
  • take limited screenshots for private study.
  • Users may not publicly distribute or commercially exploit substantial parts of the service.

49. Prohibited use

Users must not:

  • copy or redistribute substantial parts of LingoGap;
  • publish paid lessons or exam sets;
  • share or resell subscription access;
  • scrape or systematically extract content;
  • use bots or automated systems to consume content or AI allowances;
  • bypass access restrictions;
  • circumvent usage limits;
  • attempt unauthorised access;
  • disrupt servers or security controls;
  • reverse engineer protected functionality except where law permits;
  • remove ownership notices;
  • use LingoGap content to build or train a competing commercial database or product without permission; or
  • use the service unlawfully.

50. Account deletion

LingoGap does not currently provide a complete self-service account-deletion button.

A user may request account deletion by contacting:

support@lingogap.dk

LingoGap may need to verify the requester’s identity.

Before deletion, LingoGap may need to:

  • resolve an active subscription;
  • complete a pending refund;
  • retain legally required billing or accounting records;
  • preserve limited records concerning fraud or security;
  • retain evidence needed for disputes or legal claims; or
  • comply with another legal obligation.
  • Eligible profile and learning data will then be deleted or anonymised according to applicable law and the Privacy Policy.

51. Availability and maintenance

LingoGap aims to provide reliable access but does not guarantee uninterrupted or error-free operation.

Availability may be affected by:

  • maintenance;
  • updates;
  • security measures;
  • internet connectivity;
  • device or browser limitations;
  • Stripe;
  • Firebase;
  • OpenAI;
  • Vercel;
  • other service providers; or
  • circumstances outside LingoGap’s reasonable control.
  • A short or minor interruption does not automatically create a right to a full refund.
  • Mandatory remedies for material non-conformity remain unaffected.

52. Conformity of the digital service

LingoGap will provide the digital service in accordance with the subscription agreement and applicable mandatory consumer law.

If a material defect or failure occurs, the user should notify LingoGap and provide a reasonable opportunity to investigate and restore conformity.

Depending on the circumstances and applicable law, remedies may include:

  • restoration of access;
  • correction of the affected functionality;
  • replacement of defective functionality;
  • proportionate price reduction;
  • termination of the affected contract; or
  • refund of an amount legally due.

53. No general offline guarantee

LingoGap may be installable as a progressive web application or home-screen shortcut.

This does not guarantee that the service works offline.

Authentication, synchronisation, AI processing, saved progress, payment management and other server-based functions require an internet connection.

54. Changes to the service

LingoGap may update, improve, replace or reorganise service functionality for valid reasons, including:

  • correction of errors;
  • maintenance;
  • security;
  • legal compliance;
  • technical compatibility;
  • educational improvement;
  • prevention of abuse;
  • replacement of service providers; or
  • improvement of performance.
  • Material changes that negatively affect an active paid subscription will be handled in accordance with applicable consumer law.
  • This clause does not permit arbitrary removal of the essential service purchased by the user.

55. Changes to plan allowances

LingoGap may adjust future plan features or usage allowances for valid commercial, technical, security or service-quality reasons.

A change will not retrospectively alter a completed paid period.

Where a material change affects an ongoing paid subscription, LingoGap will provide any notice, information or cancellation opportunity required by applicable law.

Exact allowances shown and accepted for a particular purchase remain relevant to that subscription period.

56. Future, preview and experimental features

A feature identified as:

  • preview;
  • beta;
  • experimental;
  • coming soon;
  • planned; or

unavailable

is not guaranteed to be released or permanently maintained.

References to possible future Swedish, Norwegian or other language support do not make those languages part of the current Danish subscription unless expressly included in the purchased offer.

57. Suspension and restriction

LingoGap may temporarily restrict or suspend access where reasonably necessary because of:

  • payment failure;
  • suspected unauthorised access;
  • fraud;
  • account sharing;
  • repeated circumvention;
  • scraping;
  • automated abuse;
  • misuse of AI functionality;
  • serious security risk;
  • unlawful conduct;
  • serious or repeated breach of these Terms; or
  • a legal requirement.
  • Where reasonable, LingoGap will consider whether notice or an opportunity to correct the issue is appropriate.
  • Immediate restriction may be applied where necessary to protect users, the service, payment systems or third parties.

58. Termination by LingoGap

LingoGap may terminate an account for a serious or repeated breach of these Terms.

Where an active paid subscription is affected, LingoGap will consider:

  • the seriousness of the breach;
  • whether the paid service was supplied;
  • whether a price adjustment or refund is legally required;
  • mandatory consumer-law requirements; and
  • the user’s remaining paid period.
  • LingoGap may not rely on termination to remove mandatory consumer rights.

59. Termination by the user

A user may stop using LingoGap at any time.

Stopping use does not automatically cancel recurring billing.

To prevent future charges, the user must:

  • cancel through Stripe Customer Portal; or
  • send a clear cancellation request through the available support channel.
  • Account deletion must be requested separately.

60. Third-party providers

LingoGap relies on third-party providers that may include:

  • Firebase Authentication;
  • Firestore;
  • Firebase administrative services;
  • Stripe;
  • OpenAI;
  • Vercel;
  • Google Cloud services;
  • Cloudflare infrastructure; and
  • external email services.
  • Third-party services may process information according to their role and applicable agreements.
  • LingoGap remains responsible for obligations placed on it by applicable law even where a third party performs part of the technical service.

61. Support and communications

Support requests may be sent to:

support@lingogap.dk

Users must not email:

  • passwords;
  • complete payment-card numbers;
  • authentication tokens;
  • private keys; or
  • unnecessary sensitive personal information.

Service-related communications may be delivered electronically and may include:

  • password-reset messages;
  • security notices;
  • Stripe receipts;
  • invoices;
  • billing updates;
  • cancellation confirmations;
  • support responses; and
  • legally required notices.

62. Privacy and browser storage

Personal-data processing is governed by the LingoGap Privacy Policy.

Browser storage and authentication persistence are described in the Cookie Policy.

LingoGap may use functional browser storage for purposes such as:

  • authentication persistence;
  • theme preferences;
  • audio-speed preferences;
  • support-language preferences;
  • account-activity coordination;
  • flashcard preferences; and
  • other necessary or user-requested functionality.

63. No guarantee of a particular result

Subject to mandatory law, LingoGap does not guarantee:

  • passing an examination;
  • reaching a particular language level;
  • perfect AI accuracy;
  • perfect speech recognition;
  • uninterrupted service availability;
  • compatibility with every device;
  • permanent availability of every non-essential feature; or
  • official recognition of simulator results.

64. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Subject to mandatory consumer rights, LingoGap is not responsible for indirect or unforeseeable loss caused by:

  • reliance on an unofficial AI assessment;
  • reliance on an unofficial simulator result;
  • failure to verify official examination information;
  • an unsupported device or browser;
  • the user’s internet connection;
  • unauthorised account sharing;
  • inaccurate information supplied by the user;
  • use of the service contrary to these Terms; or
  • third-party circumstances outside LingoGap’s reasonable control.

65. Complaints

Users should first contact:

support@lingogap.dk

A complaint should preferably include:

  • the account email;
  • a clear description of the issue;
  • relevant dates;
  • the subscription plan;
  • any relevant Stripe invoice or receipt reference; and
  • screenshots where useful.
  • Users retain any right to use a competent public consumer-complaint body, alternative dispute-resolution process or court process.

66. Danish law and mandatory consumer protection

These Terms are governed by Danish law.

If a consumer resides in another EU or EEA country, this choice does not remove mandatory consumer protection applicable in the consumer’s country of residence.

Nothing in these Terms restricts a right that cannot legally be waived or limited.

67. Changes to these Terms

LingoGap may update these Terms because of:

  • changes in law;
  • product development;
  • security requirements;
  • new functionality;
  • changes in payment processing;
  • changes in service providers; or
  • clarification of existing provisions.
  • The current version and effective date will be shown at the top.
  • Material changes affecting active paid users will be communicated where required.
  • Changes do not retroactively remove rights that have already arisen.

68. Severability and non-waiver

If a provision is invalid or unenforceable, the remaining provisions remain effective to the extent legally possible.

Failure to enforce a provision immediately does not permanently waive the right to enforce it later.

A discretionary exception, refund or warning in one case does not automatically require the same outcome in another case.

69. Incorporated documents

These Terms must be read together with:

  • the Privacy Policy;
  • the Cookie Policy;
  • the Withdrawal, Cancellation and Refund Policy;
  • the Pricing page applicable at the time of purchase; and
  • any specific terms clearly presented for a particular offer.

In the event of a conflict:

  • 1. mandatory applicable law prevails;
  • 2. specific purchase information shown and accepted during Checkout applies to that purchase;
  • 3. the Withdrawal, Cancellation and Refund Policy applies to withdrawal and refund procedures;
  • 4. these Terms apply generally; and
  • 5. general informational or promotional text applies only where consistent with the above.

70. Language

The official Version 1.0 of these Terms is in English.

LingoGap may provide translations for convenience.

A translation may not reduce information or consumer rights required by applicable law.
